A McMinn County, Tennessee, man is recovering from gunshot wounds after police say he assaulted his girlfriend Sunday, violated an order of protection at a home near Calhoun, and was shot several times.
When he got to the County Road 26 home sometime late Saturday or early Sunday, Reginal Moten, 37, already had an order of protection filed against him by 35-year-old Kandi Burnette, according to a statement issued by McMinn County Sheriff Joe Guy. In the statement, the sheriff described Burnette as Moten's girlfriend.
Deputies were dispatched around 1 a.m. Sunday on a reported domestic assault and possible shooting, Guy said in the statement. Emergency medical personnel responded to transport Moten to the hospital, while deputies secured the scene until Detectives Jared Price and Tim Carver arrived.
Guy said Burnette had recently left Moten, obtained warrants and an order of protection against him related to a previous domestic assault.
"Around 1 a.m. [Sunday], Moten came to the residence in violation of the order, and it appears he again assaulted Ms. Burnette, who then shot Mr. Moten several times. He sustained serious injuries and was transported to a Chattanooga hospital," Guy said.
"Moten still will face the previous charges, and now will likely be charged with violating the order of protection and the assault once he is out of the hospital," Guy said.
On Tuesday, Guy said Moten remained in the hospital where he's being treated for his injuries.
For now, no charges have been filed against Burnette in the shooting, the sheriff said.
McMinn County General Sessions Court officials said Tuesday that Moten was charged Nov. 20, 2017, with aggravated domestic assault, domestic assault, aggravated criminal trespassing, vandalism and theft. He pleaded guilty Jan. 4 to domestic assault and vandalism, while the remaining charges were dismissed.
Court officials said Moten has an active warrant for violation of probation filed against him that has not yet been served. There are no pending court dates, officials said.
